Disney, Fox And Warner Bros. Discovery have officially filed an appeal over Venu Sports. Last week, U.S. District Judge Margaret Garnett ruled in favor of Fubo, granting a preliminary injunction against the sports streaming service.
According to court documents revealed prior to the injunction, the plan was for Venu Sports to launch on August 23rd. With the injunction in place, the sports streaming service is currently prohibited from launching at all.
The appeal was filed on Aug. 19 (Monday) and it currently remains unclear how long the appeal process will take. In the meantime, the service won’t be able to launch as planned. The three companies confirmed they intention to launch the appeal almost immediately after the initial ruling and injunction was granted.
If the appeal does fail, questions will begin to be raised as to whether Venu Sports will launch at all. While the injunction is not permanent, it could remain in place for quite some time and likely until a decision at trial is made. When that trial will take place remains unknown, making the potential launch date of the service unknown as well.
With this in mind, getting the injunction overturned, and as soon as possible, could prove crucial to the future of the streaming service. As a reminder, the Venu Sports package was set to offer subscribers access to selection of sports channels from all three companies for $42.99 a month.
Earlier this week, DirecTV weighed in on the recent ruling, explaining that it agreed with the court’s decision. DirecTV also argued that it is now time for programmers and pay TV distributors to work together to offer consumers more flexible packages and lower-priced alternatives.
